“The Indonesian company who is eligible to be a visa sponsor is the one who has paid up capital minimum IDR 1 billion Rupiah”
Based on Indonesian Law, there are three entities who are eligible to be a Sponsor of visa for foreigner or expatriate. The position of sponsor (or guarantor) in the process of obtaining visa for the expatriate is very important. The Law No. 6 / 2011 on Immigration explains the definition of sponsor (guarantor) as a person or corporation who is responsible for the existence ad activities of foreigners/expatriate for being in the territory of Indonesia.
First, Indonesian spouse of the foreigner who will come to Indonesia, in the context of mixed-married couple. The foreigner who married with Indonesian citizen could seek for a sponsor from his or her spouse. The Indonesian spouse of the foreigner can be a sponsor of ordinary visa.
Second, Indonesian citizen – in general – is also eligible to be sponsor of foreigner’s visa. The type of visa that could be sponsored by ordinary Indonesian citizen are renewal Visa on Arrival and Repatriate Visa.
Third, Indonesian Company could also be eligible to be sponsor for expatriate (a foreigner who will come to Indonesian for working). However, the Indonesian Law said not all Indonesia Company can be a sponsor for its expatriate employees. The Indonesian company who is eligible to be a visa sponsor is the one who has paid up the capital minimum IDR 1 Billion. This kind of company can be a sponsor for working visa for its expatriate employee.
Furthermore, the sponsor also has various type of responsibilities after sponsoring foreigner or expatriate to get Indonesian visa. The responsibilities are: (1) the sponsor is responsible for the existence and activities of the foreigner or expatriate during his or her stay in Indonesia;
(2) the sponsor is obliged to report any change of civil status, immigration status, and change of address; and
(3) the sponsor shall pay costs incurred to repatriate or release a foreigner or expatriate that has been sponsored from Indonesia if he or she: (a) has expired residence permit and/or (b) be subject to administrative actions immigration deportation.
