Is it allowed for Indonesian citizen who married to a foreigner directly apply for a permanent stay permit for his/her spouse?
According to Law No. 6 of 2011 regarding Immigration, Permanent Stay Permit (ITAP / KITAP) is a permit that given to a particular foreigner to permanently stay and have a domicile in Indonesia and considered as Indonesian Resident.
For a foreigner who’s married to an Indonesian citizen spouse or mixed marriage couple, they are entitled to obtain a stay permit in Indonesia trough Limited Stay Permit (ITAS / KITAS) or KITAP.
Please note that for a mixed marriage couple that legally married and acknowledge by Indonesian Law for more than two (2) consecutive years, their Indonesian citizen spouse as guarantor can apply for change of status from ITAS to ITAP. However, different procedure apply for expatriate which they must consecutively maintain their stay permit for 5 (five) years first before they could apply for a KITAP.
KITAP is valid for 5 (five) years and can be renewed for an indefinite period so long it is not canceled or annulled pursuant to the prevailing Indonesian Law and Regulation
